1. Controller
The controller responsible for data processing on this website and in the shop within the meaning of the General Data Protection Regulation (GDPR) is:
Marko Sender, trading as "Kamecardz" Rahlstedter Weg 135 22147 Hamburg Germany Email: support@kamecardz.com
No data protection officer has been appointed, as there is no legal obligation to do so.
2. General Information
We process personal data only to the extent necessary to operate the website, to handle orders and card purchases, or on the basis of your consent. The legal bases are in particular:
- Art. 6(1)(a) GDPR: consent
- Art. 6(1)(b) GDPR: performance of a contract or pre-contractual measures
- Art. 6(1)(c) GDPR: legal obligations (e.g. retention obligations)
- Art. 6(1)(f) GDPR: legitimate interests
This website uses SSL/TLS encryption, which you can recognise by "https://" in the address bar.
3. Website Hosting and Server Log Files
The website kamecardz.com is hosted by Hostinger operations, UAB / HOSTINGER, UAB, Švitrigailos str. 34, LT-03230 Vilnius, Lithuania. A data processing agreement pursuant to Art. 28 GDPR is in place with the provider.
When you visit the website, the server automatically stores the following data in log files:
- IP address
- date and time of access
- page accessed and referrer URL
- browser type, operating system
This processing serves the secure and stable operation of the website (Art. 6(1)(f) GDPR). Log files are deleted automatically by Hostinger after a short period unless they are needed to investigate a security incident.
4. Cookies and Local Storage
The website itself sets no cookies and loads no advertising services. So that your shopping cart is kept while you browse, we store it in your browser's local storage. This data stays on your device and is only sent to Shopify when you go to the checkout. This storage is strictly necessary for the service you request (Section 25(2) no. 2 TDDDG, Art. 6(1)(b) GDPR). The cards you save with the heart as favourites are stored there as well; as long as you are not signed in, this list stays on your device. If you are signed in to your customer account, it is also saved there (see section 11a). You can delete this data at any time in your browser settings.
Visitor statistics (Cloudflare Web Analytics): To understand which pages are visited and how fast they load, we use Cloudflare Web Analytics by Cloudflare, Inc., 101 Townsend St., San Francisco, CA 94107, USA. No cookies are set, nothing is stored on your device and no profiles of individual visitors are created. When you open a page, your browser loads a small script from Cloudflare and transmits the page visited, the referring page, browser and device type, loading times and your IP address; according to Cloudflare, this data is only evaluated in aggregated form and the IP address is not used to track individual visitors. The legal basis is our legitimate interest in a working, fast website and in improving our offer (Art. 6(1)(f) GDPR). Cloudflare is certified under the EU-US Data Privacy Framework (adequacy decision of the EU Commission, Art. 45 GDPR). If you do not want to be counted, you can block scripts from static.cloudflareinsights.com in your browser or with a content blocker; the website works the same.
Fonts and graphics are hosted on our own server. No connection to Google Fonts or similar services is made when you visit the website.
The Shopify checkout sets cookies. Technically necessary cookies (e.g. for the cart and payment) are set by Shopify without consent; all other cookies, for example to measure how the checkout is used, are only set with your consent via the cookie banner in the checkout (Section 25(1) TDDDG, Art. 6(1)(a) GDPR). You can withdraw your consent there at any time via "Manage preferences".
5. Shop System and Checkout (Shopify)
We manage our products, prices and stock with Shopify, provided by Shopify International Limited, Victoria Buildings, 2nd Floor, 1–2 Haddington Road, Dublin 4, D04 XN32, Ireland. A data processing agreement pursuant to Art. 28 GDPR is in place with Shopify.
When you visit the website, your browser loads product data and product images from Shopify's servers. In doing so, your IP address is transmitted to Shopify. This is necessary to show you current prices, stock and images (Art. 6(1)(f) GDPR).
When you go to the checkout, you are forwarded to the Shopify checkout. There, Shopify processes the data described in sections 6 and 7 on our behalf (Art. 6(1)(b) GDPR). Shopify may transfer data to Shopify Inc. in Canada and to service providers in the USA. For Canada, an adequacy decision of the European Commission exists; transfers to the USA are based on the EU-US Data Privacy Framework or EU Standard Contractual Clauses.
More information: https://www.shopify.com/legal/privacy
6. Orders
To process an order, we process your name, billing and delivery address, email address, telephone number if provided, and order and payment data (Art. 6(1)(b) GDPR). Invoices and accounting records are retained in accordance with statutory periods (Art. 6(1)(c) GDPR in conjunction with Section 147 AO and Section 257 HGB).
7. Payment
Depending on the payment method you choose, the necessary payment data is transmitted to the respective payment service provider (Art. 6(1)(b) GDPR). We do not receive full card details ourselves.
- Credit card, Apple Pay, Google Pay and Shop Pay: via Shopify Payments (Shopify International Limited, address see section 5). For payment processing, Shopify Payments uses Stripe Payments Europe, Ltd., 1 Grand Canal Street Lower, Dublin, Ireland. Privacy policy: https://stripe.com/privacy
- PayPal: PayPal (Europe) S.à r.l. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg. Privacy policy: https://www.paypal.com/us/legalhub/privacy-full
- Klarna: Klarna Bank AB (publ), Sveavägen 46, 111 34 Stockholm, Sweden. Privacy policy: https://www.klarna.com/international/privacy-policy/
For Apple Pay and Google Pay, the privacy policies of Apple and Google also apply. Some payment service providers may transfer data to the USA. Such transfers are based on the EU-US Data Privacy Framework or EU Standard Contractual Clauses.
8. Shipping
For delivery, we pass your name and delivery address to DHL Paket GmbH / Deutsche Post AG, Sträßchensteg 2, 53113 Bonn, Germany (Art. 6(1)(b) GDPR). We only pass on your email address or telephone number with your express consent, so that DHL can notify you about delivery (Art. 6(1)(a) GDPR). You can withdraw this consent at any time.
9. Card Purchases (Buy-in)
When you send the sell request form on our website, your name, email address, the card details, your note and the photos you add are transmitted encrypted to our web server at Hostinger and forwarded from there to us by email. So that no request gets lost if an email does not arrive, the server also keeps a backup copy of the request with the photos in a folder that cannot be reached from the internet; it is deleted automatically after 30 days. You receive a confirmation email. Instead of the form you can also simply email us. We process your name, email address, the details and photos of the cards, your postal address for shipping and, if the offer is accepted, your payment details for the payout (IBAN or PayPal address). If paid out via PayPal, we pass your PayPal address and the amount to PayPal (Europe) S.à r.l. et Cie, S.C.A. The legal basis is Art. 6(1)(b) GDPR. If no purchase takes place, we delete the data after 6 months. For completed purchases, statutory retention periods apply.
Notify me (sold-out cards): If you ask to be notified when a sold-out card is back, your email address and the card are sent to us by email in the same way. We use your email address only to tell you once about this card and delete the request once that is done, at the latest after 12 months. The legal basis is Art. 6(1)(b) GDPR (your request).
10. Contact by Email
If you contact us by email, including via the contact form on the website, which opens your email program, we process your details to handle your enquiry (Art. 6(1)(b) or (f) GDPR). We delete them once the enquiry has been dealt with and no retention obligation applies.
11. News by Email
Newsletter: If you sign up for our newsletter on the website, we pass your email address to Shopify (see section 5) and create a contact for you there. We send you a confirmation email from support@kamecardz.com; you are only subscribed once you click the link in it (double opt-in). The link is valid for 7 days; if you don't confirm, your contact in Shopify stays unsubscribed and receives no marketing. We then send you news about new cards and offers. The legal basis is your consent (Art. 6(1)(a) GDPR). You can withdraw it at any time via the unsubscribe link in every email or by email to support@kamecardz.com.
Welcome code: When you confirm the newsletter and have not ordered with us yet, Shopify creates a personal discount code for you, which we save in your Shopify customer contact and send you by email. Your browser also keeps the code in its local storage so that it can be added at checkout automatically. The legal basis is Art. 6(1)(b) GDPR (the promised welcome gift).
If you ask us by email to keep you informed about a specific card (e.g. via "Notify me"), we use your email address only for this purpose (Art. 6(1)(a) GDPR). You can withdraw at any time with a short email to support@kamecardz.com.
11a. Customer Account and Collection Album
You can sign in at kamecardz.com/account/ with your email address. Sign-in runs through Shopify (see section 5): you receive a one-time code by email, there is no password. Shopify stores your account and your orders. To keep you signed in, the website keeps a sign-in key in your browser's local storage; this is strictly necessary for the account you requested (Section 25(2) no. 2 TDDDG). In the collection album we show the cards from your orders with their current market value; your browser loads your orders directly from Shopify. You can also add cards you bought elsewhere: this list (card, condition, quantity and, if you enter it, the price you paid) is saved in your Shopify customer account. If you add a photo of your card, it is reduced in size in your browser (location and camera data are removed) and stored on our web server at Hostinger (see section 3) in a folder that belongs to your account; it is only shown in your album. When you remove the photo or the card, the photo is deleted. Cards you put on your wanted list (and the highest price you set), and the cards you save with the heart while signed in, are also saved in your Shopify customer account. When such a card comes into our shop, we send you a push notification (if you turned them on) and an email to the address of your account; you can remove cards from the wishlist at any time. The legal basis is the performance of the contract for the customer account (Art. 6(1)(b) GDPR). You can sign out at any time and ask for your account to be deleted by email to support@kamecardz.com.
11b. Push Notifications
If you turn on notifications in your customer account and agree in your browser or on your iPhone, we store this device's technical delivery address (push subscription) in your customer account at Shopify. The notifications themselves are delivered by the push service of your browser or device maker (e.g. Apple, Google or Mozilla); this may involve a transfer to the USA. We send at most a few notifications a month about new cards and offers. The legal basis is your consent (Art. 6(1)(a) GDPR, Section 25(1) TDDDG). You can withdraw it at any time with “Turn off” in your customer account or in your device settings.
11c. Invite Friends
In your customer account you get a personal invite code and link. We save the code in your Shopify customer account. When someone opens your link, their browser keeps your code in its local storage for 60 days, so it can be added at their checkout; no data about them is sent to you or to us at that point. If a friend orders with your code, Shopify records the code with the order. Every night a script checks such orders (paid, not cancelled or refunded, first order, shipped at least 17 days ago) and books the reward as store credit to your Shopify customer account; Shopify emails you about it. In your customer account we save how many friends have ordered and the credit earned, without their names. You never see who your friends are or what they ordered. The legal basis is Art. 6(1)(b) GDPR (the invite programme you take part in, see kamecardz.com/rewards/) and, for checking orders against misuse, Art. 6(1)(f) GDPR. The data is kept as long as your customer account exists; order data is subject to the statutory retention periods.
12. Links to Social Networks
On the website we link to our profiles on Instagram (Meta Platforms Ireland Limited, Merrion Road, Dublin 4, D04 X2K5, Ireland) and X (Twitter International Unlimited Company, One Cumberland Place, Fenian Street, Dublin 2, D02 AX07, Ireland). These are plain links: no data is transferred to these networks when you visit our website. Only when you click a link does the network's page open, and its privacy policy applies.
13. Storage Period
We store personal data only as long as necessary for the respective purpose. After that we delete it, unless statutory retention periods apply (up to 10 years under Section 147 AO and Section 257 HGB). In that case, the data is restricted from use for other purposes.
14. Your Rights
You have the right at any time to:
- access (Art. 15 GDPR)
- rectification (Art. 16 GDPR)
- erasure (Art. 17 GDPR)
- restriction of processing (Art. 18 GDPR)
- data portability (Art. 20 GDPR)
- withdraw consent with effect for the future (Art. 7(3) GDPR)
Right to object (Art. 21 GDPR): Where we process data on the basis of legitimate interests, you may object at any time on grounds relating to your particular situation. A short email to support@kamecardz.com is sufficient.
15. Right to Lodge a Complaint
You may lodge a complaint with a data protection supervisory authority. The authority responsible for us is: Der Hamburgische Beauftragte für Datenschutz und Informationsfreiheit (Hamburg Commissioner for Data Protection and Freedom of Information), Ludwig-Erhard-Straße 22, 20459 Hamburg, Germany.
16. Changes
We update this privacy policy when our website or the legal situation changes. The current version on this page applies.
In case of discrepancies, the German version of this privacy policy prevails.

15. Beschwerderecht
Du kannst dich bei einer Datenschutz-Aufsichtsbehörde beschweren. Zuständig für uns ist: Der Hamburgische Beauftragte für Datenschutz und Informationsfreiheit, Ludwig-Erhard-Straße 22, 20459 Hamburg.
